By accessing or using https://www.decluttergta.com, the Site, you agree to be bound by these Terms and all applicable laws. If you do not agree, do not use the Site or our services.

About us and scope

Declutter GTA provides junk removal and cleaning services in Ontario, Canada. These Terms govern your use of the Site and any bookings made through the Site, by phone, by email, or through third party platforms.

Intellectual property

All content on the Site, including text, images, graphics, logos, videos, icons, and code, is owned by Declutter GTA or its licensors and is protected by copyright, trademark, database, and other intellectual property laws. You may view and print content for personal, non commercial use. Any other use, including copying, modifying, distributing, or creating derivative works, requires prior written permission. These Terms do not grant any license to use Declutter GTA trademarks.

User accounts and accuracy

If you create an account or submit a booking, you agree to provide accurate, current, and complete information, and to keep it updated. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

Third party links and services

The Site may link to third party websites or services not owned or controlled by Declutter GTA. We are not responsible for the content, privacy policies, or practices of third parties. Your use of third party sites is at your own risk. Review their terms and privacy policies before use.

Quotes, pricing, and payment

Online or phone estimates are non binding and are based on the information you provide. Final pricing is determined on site by volume, weight, item type, access conditions, and disposal fees. Additional fees may apply for stairs, long carries, disassembly, oversized or unusually heavy items, after hours service, or restricted access. We do not handle hazardous waste, chemicals, biological materials, pressurized tanks, explosives, or other items restricted by law. Payment is due upon completion unless otherwise agreed in writing. We may accept cash, debit, credit card, or third party processors, and by providing payment information you authorize charges for the agreed amount, taxes, and applicable fees. All prices are subject to applicable sales taxes.

Scheduling, access, and cancellations

Service windows are estimates and may vary due to traffic, weather, or job conditions. You must provide safe and lawful access to the premises, parking, and elevator bookings if required, and you must disclose any risks such as pests, mold, or structural hazards. Cancellations or reschedules made within [24] hours of the appointment may incur a fee, and missed appointments may be charged a call out fee. Upon removal and full payment, title to items passes to Declutter GTA, and items may be recycled, donated, resold, or disposed of at our discretion.

Customer representations

You represent that you own the items to be removed or have authority to dispose of them, and that removal will not violate any lease, by law, or third party right. You agree to clear pathways and to secure pets and children during service.

Acceptable use

You agree not to misuse the Site or Services, including by scraping, reverse engineering, uploading malware, interfering with security features, sending spam, or engaging in unlawful, infringing, or harmful conduct.

Privacy

Your use of the Site is subject to our Privacy Policy, which explains how we collect, use, disclose, and safeguard personal information in accordance with Canadian law. The Privacy Policy is incorporated by reference.

Disclaimers

Your use of the Site and Services is at your sole risk. The Site is provided on an as is and as available basis. Declutter GTA disclaims all warranties to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, non infringement, and course of performance. We do not warrant that the Site will be uninterrupted, timely, secure, error free, or free of harmful components. Field conditions vary, and results may differ from estimates.

Limitation of liability

To the fullest extent permitted by law, Declutter GTA, its directors, officers, employees, contractors, agents, suppliers, and affiliates are not liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising from or related to your use of the Site or Services, inability to use the Site, third party conduct or content, content obtained through the Site, or unauthorized access to or alteration of transmissions or content, whether based in warranty, contract, tort, negligence, or any other legal theory, even if advised of the possibility of such damages. In all cases, our aggregate liability will not exceed the amount you paid for the relevant Service in the three months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Declutter GTA, its principals, officers, directors, employees, contractors, licensors, suppliers, and agents from and against all claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising out of or related to your use of the Site or Services, your breach of these Terms, or your violation of law or third party rights.

Service modifications and availability

We may modify, suspend, or discontinue the Site or any Service, in whole or in part, at any time without notice. We may impose limits on certain features or restrict access without liability.

Governing law and venue

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws rules. You submit to the exclusive jurisdiction of the courts located in Toronto, Ontario.

Dispute resolution and notice

Before filing a claim, you agree to provide written notice of the dispute to info@decluttergta.com and to attempt good faith resolution for 30 days. Notices to you may be sent to the email or mailing address you provided.

Severability, waiver, and entire agreement

If any provision is found unenforceable, the remaining provisions remain in full force. No waiver of any term is a waiver of any other term, nor a continuing waiver. These Terms, together with the Privacy Policy and any service specific terms, form the entire agreement between you and Declutter GTA regarding the Site and Services.

Changes to these terms

We may update these Terms at any time. Changes take effect upon posting to the Site with an updated effective date. Your continued use of the Site after changes indicates acceptance.
